Who pays for compensation after a Lyft or Uber accident?
New Jersey state law requires ridesharing companies such as Lyft and Uber to provide minimum amounts of insurance coverage for drivers in different situations. There are basically three situations in which different insurance policies would apply:
The driver is logged off
If the driver is not logged into the app and is not waiting to accept a ride request, that driver’s own insurance company would be responsible for damages in an accident.
The driver is logged in and has no passenger
If the driver is logged in to the app and waiting for a ride request, there must be coverage that includes $50,000 for bodily injury or death per person, $100,000 for bodily injury or death per accident, and $25,000 in property damage.
The driver has a passenger or is picking one up
There must be coverage that includes up to $1.5 million in bodily damage, property damage, or death, and $10,000 in medical coverage.
What causes ridesharing accidents? Many times, these accidents are caused by negligence. A driver was speeding or checking the app while driving. A driver was entering a location into a GPS and wasn’t paying attention to the road. The driver may have been asleep at the wheel. Or the driver was operating recklessly, blowing through red lights and weaving through traffic.
We hold negligent drivers accountable
When you’ve been hurt in a crash caused by a negligent rideshare driver, either as a passenger or as another motorist, recovering compensation for your injuries seems like it should be straightforward. Unfortunately, that usually isn’t the case. Negligent drivers typically deny doing anything wrong, partly because they don’t want to be blamed for the crash and have it on their record.
But insurance companies aren’t on your side, either. That goes for the driver’s insurance company and the company carrying the Lyft or Uber policy. The goal of adjusters is to limit payment amounts to help keep the insurance company profitable. There are a number of tactics they use to try to justify paying less.
Attorney Leigh knows all of these tactics quite well. He used to represent insurance companies. He knows how they approach accident claims and where they look to try to minimize your claim. Insurance companies may question the seriousness of your injuries or seek access to your medical history to argue they were pre-existing. Sometimes they’ll just make a quick settlement offer – one that falls far short of covering all of the damages you suffered.
Insurance companies have attorneys fighting for their best interests. You need an experienced car accident attorney who will fight for you. Attorney Leigh is dedicated to making a difference by helping you get the results you need and deserve.
