Who pays for compensation after a Lyft or Uber accident?

New Jersey state law requires ridesharing companies such as Lyft and Uber to provide minimum amounts of insurance coverage for drivers in different situations. There are basically three situations in which different insurance policies would apply:

The driver is logged off

If the driver is not logged into the app and is not waiting to accept a ride request, that driver’s own insurance company would be responsible for damages in an accident.

The driver is logged in and has no passenger

If the driver is logged in to the app and waiting for a ride request, there must be coverage that includes $50,000 for bodily injury or death per person, $100,000 for bodily injury or death per accident, and $25,000 in property damage.

The driver has a passenger or is picking one up

There must be coverage that includes up to $1.5 million in bodily damage, property damage, or death, and $10,000 in medical coverage.
